1. Definitions

• "Platform" refers to the website at https://clearshorts.com and all its associated pages, features, and services.
• "ClearShorts", "we", "us", or "our" refers to the operators of this Platform.
• "User", "you", or "your" refers to any individual who registers, accesses, or uses the Platform.
• "Content" refers to all text, capsule cards, video shorts, PDFs, mock tests, questions, explanations, and other materials available on the Platform.
• "Premium Membership" refers to any paid subscription plan that grants access to premium Content on the Platform.
• "JAIIB" refers to the Junior Associate of Indian Institute of Bankers examination conducted by the Indian Institute of Banking and Finance (IIBF).
• "IIBF" refers to the Indian Institute of Banking and Finance, which is an autonomous body and has no affiliation with ClearShorts.

2. Acceptance of Terms

By creating an account, accessing any content, or completing any purchase on ClearShorts, you agree to be legally bound by these Terms and Conditions, our Privacy Policy, and our Refund Policy, all of which are incorporated herein by reference.

These Terms constitute a legally binding agreement between you and ClearShorts. If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Eligibility

You may use this Platform only if you:

• Are at least 18 years of age.
• Are a bank employee, JAIIB aspirant, or someone with a genuine interest in banking knowledge.
• Are legally capable of entering into a binding contract under Indian law.
• Are not barred from using our services under any applicable law.

ClearShorts is designed specifically for individuals preparing for IIBF examinations. It is not affiliated with, endorsed by, or officially connected to IIBF or any bank.

4. User Accounts

• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at clearshorts360@gmail.com if you suspect any unauthorised access to your account.
• One account per person. Creating multiple accounts to circumvent restrictions, exploit free trials, or abuse referral systems is prohibited and will result in permanent account suspension.
• We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

5. Services & Memberships

ClearShorts offers the following:

• Free tier: Limited access to selected capsule cards and content.
• Premium Membership: Full access to all capsule cards, video shorts, mock tests, PDF notes, and other premium features for the duration of your chosen plan.

Premium Membership is personal and non-transferable. You may not share your account credentials or allow others to access premium content using your account.

We reserve the right to modify, add, or remove features from any membership tier at any time. We will provide reasonable notice for any material changes that reduce the value of a plan you have already purchased.

Membership access begins immediately upon successful payment confirmation and expires on the date stated in your membership confirmation email.

6. Payments & Billing

• All prices are displayed in Indian Rupees (₹) inclusive of applicable taxes unless stated otherwise.
• Payments are processed securely through Razorpay. By making a payment, you also agree to Razorpay's Terms of Service.
• Membership is activated immediately upon successful payment verification.
• Memberships do not auto-renew unless explicitly stated. You must manually repurchase upon expiry.
• In the event of payment failure, any amount deducted will be automatically refunded by Razorpay as per their standard reconciliation process (typically 5–7 business days). ClearShorts is not liable for delays in such refunds.
• Please refer to our Refund Policy for complete details on refund eligibility. By completing a purchase, you explicitly agree to our No-Refund Policy.

7. ⚠️ Educational Disclaimer

The content on ClearShorts — including capsule cards, video shorts, mock tests, PDF notes, and any other study material — is designed to supplement your JAIIB examination preparation. It is intended to help you understand concepts more easily, retain information faster, and potentially improve your score by the extra 5 to 10 marks that many candidates lack.

However, we expressly and unambiguously state the following:

• ClearShorts does not guarantee that you will pass the JAIIB examination. Examination outcomes depend on numerous factors outside our control, including but not limited to: the difficulty of the question paper set by IIBF, your individual preparation level, time devoted to study, performance on examination day, changes in the JAIIB syllabus by IIBF, and other personal circumstances.
• Relying solely on ClearShorts content is not sufficient preparation for the JAIIB examination. You are strongly advised to also study the official IIBF study materials, recommended textbooks, and any other resources as prescribed by IIBF.
• Our mock tests and practice questions are prepared based on publicly available syllabus information and past paper analysis. They are not official IIBF questions and may not exactly replicate the actual examination pattern, difficulty level, or question style.
• Any testimonials, success stories, or indicative score improvements mentioned on the Platform reflect individual experiences and are not guarantees of similar results for any other user.
• IIBF may update the JAIIB syllabus, examination pattern, or passing criteria at any time. While we endeavour to keep our content current, we cannot guarantee that all material on the Platform reflects the most recent IIBF guidelines at all times. Users are responsible for verifying the current official syllabus directly with IIBF at www.iibf.org.in.

8. Intellectual Property

All content on ClearShorts — including capsule cards, video shorts, mock test questions, explanations, PDF notes, graphics, logos, and the Platform's source code — is the exclusive intellectual property of ClearShorts and is protected by applicable Indian and international copyright laws.

• You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the content for your personal, non-commercial JAIIB preparation purposes only.
• You may not reproduce, copy, distribute, sell, resell, sublicense, publicly display, create derivative works from, or otherwise exploit any content from this Platform without our prior written consent.
• You may not use automated tools (bots, scrapers, crawlers) to extract content from the Platform.
• Sharing premium content (screenshots, downloads, recordings) publicly or with non-members is strictly prohibited and constitutes copyright infringement.

9. Acceptable Use & Prohibited Conduct

You agree not to:

• Attempt to gain unauthorised access to any part of the Platform, other user accounts, or our servers.
• Reverse engineer, decompile, or attempt to extract the source code of the Platform.
• Upload, transmit, or distribute malware, viruses, or any malicious code.
• Use the Platform for any unlawful purpose or in violation of any applicable Indian law.
• Harass, abuse, defame, or harm any other user or Platform staff.
• Misrepresent your identity or affiliation.
• Attempt to manipulate mock test scores, reactions, view counts, or any other Platform metrics.
• Use the Platform in any manner that could damage, disable, or impair its normal operation.

Violation of any of the above may result in immediate account suspension or permanent ban without refund.

10. Third-Party Services

The Platform uses certain third-party services including Razorpay (payments) and ip-api.com (country detection for analytics). Links to external websites or services may appear in our content. We are not responsible for the content, policies, or practices of any third-party service or website. Accessing third-party services is entirely at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ClearShorts and its operators, employees, and agents shall not be liable for:

• Any failure to pass the JAIIB examination or any other examination, whether or not you used our Platform.
• Loss of employment opportunity, salary increment, promotion, or any career-related consequence.
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Any interruption, suspension, or discontinuation of the Platform or any of its features.
• Errors, inaccuracies, or outdated information in our study content, notwithstanding our efforts to maintain accuracy.
• Loss of data or breach of data security caused by circumstances beyond our reasonable control.

Our total aggregate liability to you for any claim arising from your use of the Platform shall not exceed the total amount paid by you to ClearShorts in the 6 months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless ClearShorts and its operators, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your infringement of any third-party rights; or (d) any content you submit to the Platform.

13. Termination

We reserve the right to suspend or permanently terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud, or caused harm to other users or the Platform.

You may terminate your account at any time by contacting us at clearshorts360@gmail.com. Account termination does not entitle you to a refund of any unused membership period — please see our Refund Policy.

Sections 7 (Disclaimer), 8 (Intellectual Property), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) shall survive termination of these Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution: In the event of any dispute arising out of or in connection with these Terms or the Platform, the parties shall first attempt to resolve the dispute amicably through good-faith negotiation. If the dispute is not resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in India.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by sending an email notification to your registered email address. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
